I very much like the idea of objective criteria that are developed by disputants penetrating into the legal system, as it is stated here. Maybe this point could be somewhat further extended. How would this be possible? Are there other examples of rules that were developed outside the legal system being accepted as legal rules? How was this done?
I am not very sure whether the legal system supplies a lot of legal rules that can 'easily be used as objective criteria'. Our codes contain quite some standards, that is (open normen). also, case law often may not give very clear direction because of abundancy and diversity.
